Description

Within this subdivision, corruption refers to the abuse of entrusted power for private gain, excluding those offences classified elsewhere (such as embezzlement). The person in the position of entrusted power may or may not be a public official.

For bribery, where it is unknown whether a government official was involved code to 0830 Corruption, not further defined.

0831 Bribery involving a government official

Bribery is defined as the offering, giving, or accepting of a bribe. A government official refers to any person who holds specific powers or responsibilities due to their employment or election within federal, national, state, territory, or local government, where this power or responsibility is relevant to the offering, giving, or receiving of the bribe. The bribe may be money, a gift, or act of financial or personal value.

Inclusions:

  • Accept or offer monetary or non-monetary bribes, involving a government official
  • Breach anti-corruption legislation relating to public servants and elected officials
  • Bribery involving a foreign public official
  • Other bribery involving a government official

0832 Bribery (excluding government officials)

Bribery is defined as the offering, giving, or accepting of a bribe. Offences in this group do not include a government official, as defined in 0831 Bribery involving a government official. The bribe may be money, a gift, or act of financial or personal value.
