Description

This division includes the unlawful taking or obtaining of money or goods, not involving the use of force, threat of force or violence, coercion, or fraud, to deprive the owner or possessor of the use of the money or goods, or the receiving or handling of money or goods obtained unlawfully.

Subdivision

071 Motor vehicle theft and related offences

Description

This subdivision includes the taking of another person’s motor vehicle illegally and without permission, either temporarily or permanently. It also includes theft of vehicle parts or contents.

A motor vehicle is any self-propelled vehicle that runs on land and is eligible for registration for use on public roads. This includes, but is not limited to: car, motorcycle, campervan, truck, lorry, tractor, bus, grader, etc.

Where it is unknown if the vehicle was intended to be taken permanently (theft) or temporarily (illegal use), the offence should be coded to 0710 Motor vehicle theft and related offences, not further defined.

0711 Theft of a motor vehicle

Theft of a motor vehicle involves the taking of another person’s motor vehicle (as defined for this subdivision) illegally and without permission, with the intent of permanently depriving the owner or possessor of the use of the vehicle. 

Where theft and illegal use of a motor vehicle cannot be disaggregated, offences should be coded to 0710 Motor vehicle theft and related offences, not further defined.

Inclusions:

  • Permanently take a motor vehicle without consent
  • Steal a motor vehicle by conversion (rent to steal)
  • Other theft of a motor vehicle

Exclusions:

  • Offences relating to the operation of a stolen vehicle – coded to relevant groups in 13 Traffic and vehicle offences
  • Take a vehicle by force, including carjacking – coded to relevant groups in 051 Robbery
  • Theft of a tram, train, ship, aircraft, boat, vessel, bicycle, wheelchair or any other vehicle not self-propelled or eligible for registration on public roads – coded to 0792 Theft of other vehicles.
  • Unlawfully take parts or contents from another person’s vehicle illegally and without permission – coded to 0713 Theft of vehicle parts or contents

Where theft and illegal use of a motor vehicle cannot be disaggregated, offences should be coded to 0710 Motor vehicle theft and related offences, not further defined.

0712 Illegal use of a motor vehicle

Illegal use of a motor vehicle includes the taking or use of another person’s motor vehicle (as defined for this subdivision) illegally and without permission, without the intent of temporarily depriving the owner or possessor of the use of the vehicle. This may include where the offender did not take the vehicle themselves.

Where theft and illegal use of a motor vehicle cannot be disaggregated, offences should be coded to 0710 Motor vehicle theft and related offences not further defined.

Inclusions:

  • Illegal use of a motor vehicle temporarily without consent, including joyriding
  • Unlawfully use a stolen motor vehicle as a passenger or driver
  • Other illegal use of a motor vehicle

Exclusions:

  • Offences relating to the unsafe driving of a stolen vehicle – coded to relevant groups within 13 Traffic and vehicle offences
  • Permanently take a motor vehicle without consent – coded to 0711 Theft of a motor vehicle
  • Take a vehicle by force, including carjacking – coded to the relevant groups in 051 Robbery
  • Use a vehicle to intentionally cause injury – coded to the relevant groups within 02 Assault

0713 Theft of motor vehicle parts or contents

This group involves the taking of parts or contents from another person’s motor vehicle illegally and without permission. 

Note that in some jurisdictions, break and enter of a vehicle may be considered burglary and coded to a group in 069 Other burglary offences.

Inclusions:

  • Theft of car parts such as numberplates, catalytic converters, navigation systems, or other car parts
  • Theft of items from within a motor vehicle
  • Other theft of vehicle parts or contents

Exclusions:

  • Theft from a vehicle other than a motor vehicle as defined for this subdivision
  • Burglary of a vehicle where someone lives, such as a houseboat – coded to the relevant group in 061 Burglary of a dwelling

0720 Theft from a person

Theft from a person includes the taking of property, money, or personal goods, from the immediate possession or control of a person without the use of intentional force, threat, or violence towards the victim. 

Inclusions:

  • Bag snatching where no assault or threat takes place
  • Pickpocketing
  • Theft from residential premises where entry was lawfully gained 
  • Theft of personal items from public places, such as phone, wallet, or sunglasses
  • Other theft of personal items

Exclusions:

  • Theft from a person with the use of force, threat of force, or by putting the victim in fear – coded to the relevant groups within 051 Robbery
  • Theft of money or assets belonging to one’s employer – coded to 0823 Embezzlement
  • Theft of personal data or information – coded to 0841 Privacy offences
  • Theft of personal property such as phone, wallet, sunglasses from within a motor vehicle – coded to 0713 Theft of vehicle parts or contents

Theft from retail premises includes theft of goods for sale, other than vehicles, by avoiding payment for those goods.

Inclusions:

  • Fuel drive-offs
  • Shoplifting
  • Theft from market stalls
  • Theft from wholesale or factory retail outlets
  • Theft of property by conversion (rent to steal)
  • Theft of retail goods 
  • Other theft from retail premises

Exclusions:

  • Evade payment for services rendered – coded to 0799 Theft, nec
  • Illegal entry to a shop for the purposes of theft – coded to the relevant groups within 062 Burglary of a non-residential building
  • Leave a café, restaurant, pub, or bar without paying – coded to 0799 Theft, nec
  • Theft from retail premises with the use or threat of immediate force or violence – coded to the relevant groups within 051 Robbery
  • Theft from retail premises that involves the taking of tools, equipment, furnishings, or other items not for sale – coded to 0799 Theft, nec

This group includes where a person knowingly receives, manages, or possesses money or goods taken or obtained illegally. It excludes international money laundering and acts involving fraud.

  • Other acts involving receiving or handling the proceeds of crime

079 Other theft

Description

This subdivision includes the theft of money, goods, vehicles other than a motor vehicle, or services not elsewhere classified.

0791 Public transport fare evasion

Fail to pay for a valid fare on a train, bus, commuter ferry, tram, light-rail, monorail, commuter cable-car, or other public transport, or fail to provide ticket on request. 

For the purposes of this classification, public transport is defined as transport for which fare evasion is policed by public officers. This includes authorised officers, transit officers, transport officers, police officers, or other officers with authority from government to inspect transport tickets.

It excludes private transport services such as taxi, ride-share, tourist ferries, punts, gondolas, charter buses, airport transfers, tour buses, cruise ships, recreational flights in small aircraft, transport within snow resorts or sailing tours.

Inclusions:

  • Fail to provide ticket on request
  • Fail to purchase a ticket for public transport
  • Purchase a concession ticket without a valid concession
  • Travelling further than the distance paid for on the ticket
  • Other public transport fare evasion

Exclusions:

  • Avoid payment of fine by giving false name or address to an authorised officer – coded to 1521 Resist or hinder a government representative

0792 Theft of other vehicles

Theft of other vehicles is defined as the taking of a vehicle other than a motor vehicle, illegally and without permission. This includes trams, trains, ships, aircraft, boats, caravans, bicycles, trailers, wheelchairs, and scooters used on footpaths or bike paths, whether motorised or not. It also includes small, motorised vehicles such as segways, golf buggies, and go-karts that cannot be registered to be driven on public roads

Illegal use of other vehicles may also be coded here. This includes the taking or use of another person’s vehicle (other than a motor vehicle, as defined for this subdivision) illegally and without permission, without the intent of temporarily depriving the owner or possessor of the use of the vehicle. This may include where the offender did not take the vehicle themselves.

Inclusions:

  • Illegal use of other vehicles temporarily without consent
  • Permanently take other vehicles without consent
  • Steal other vehicles by conversion (rent to steal)
  • Theft of any vehicle as defined for this subdivision
  • Unlawfully take control of an aircraft without the use of force
  • Unlawfully use other vehicles as a passenger or driver
  • Other illegal use of other vehicles

Exclusions:

0799 Theft, nec

This group includes other theft or illegal use offences not elsewhere classified.

Inclusions:

  • Evade payment for services rendered
  • Fail to pay for private transport services, such as taxi, ride-share, tourist ferries, punts, gondolas, charter buses, airport transfers, tour buses, cruise ships, recreational flights in small aircraft, transport within snow resorts, or sailing tours
  • Illegal use of something other than a motor vehicle, excluding use of fraud, trespass, or hacking
  • Leave a café, restaurant, pub, or bar without paying
  • Theft from a charity donation box
  • Theft from a tip jar or box
  • Theft from retail premises that involves the taking of tools, equipment, furnishings, or other items not for sale
  • Steal electricity, gas, or water
  • Other theft not elsewhere classified

Exclusions:
