CONDITIONS OF USE
1. Access and use
You must:
- be a natural person to access or seek to access to Australian Bureau of Statistics (ABS) authenticated web pages;
- not access or link to or seek to access or link to (either directly or indirectly) any other person's ABS authenticated web pages account;
- not permit any other person to use your username and password; keep your ABS authenticated web pages account username and password secure at all times and not disclose your password to anyone else;
- advise the ABS immediately if you suspect that the security of your ABS authenticated web pages account may have been compromised e.g.: your password or username has been lost or stolen.
You are responsible for any use of your ABS authenticated web pages account using your username and password, whether or not such use has been authorised by you. Details on ABS authenticated web pages may only be accessed through the ABS authenticated web pages website, and only using the username and password details. The use of any software (e.g. bots, scraper tools) or other automatic devices to access, monitor or copy the website pages or their contents is prohibited unless expressly authorised by the ABS in writing.
2. Lawful purposes
You must use the ABS authenticated web pages for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use of ABS authenticated web pages by any third party. This includes conduct which is unlawful or which may harass or cause distress or inconvenience to any person, the transmission of obscene or offensive content or disruption to the ABS.
You must not post or transmit via ABS authenticated web pages any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.
3. General
3.1 Suspension or termination of your ABS authenticated web pages access
The ABS may lock, suspend or terminate your ABS authenticated web pages account at any time.
3.2 Severance
If any of these conditions of use are held to be invalid, unenforceable or illegal for any reason, the remaining conditons will continue in full force.
3.3 Governing law
These conditions of use are governed by the laws of the Australian Capital Territory, Australia and you agree to submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.
4. Limitation of liability
The ABS gives no warranty that ABS authenticated web pages is free of fault. The ABS will not be liable, except pursuant to any implied warranty, for any loss or damage howsoever caused whether due to negligence or otherwise arising from use of or reliance on ABS authenticated web pages. In no event shall the total liability of the ABS to you for all damages exceed the value of this licence. If any dispute arises under this licence, the prevailing party shall be reimbursed by the other party for any and all legal fees and costs associated with dispute resolution.
The ABS accepts no liability for any interference with or damage to a user's computer system, software or data occurring in connection with or relating to these authenticated web pages or its use.
5. Term and termination
You may use ABS authenticated web pages to complete your work based activities only. Your rights to use ABS authenticated web pages will terminate automatically without notice from the ABS if you fail to comply with any condition of this licence.
6. Security
You are responsible for maintaining the security of your username and password and of the environment in which the ABS authenticated web pages are used.
7. Intellectual Property
By using the Learning Management System you acknowledge and agree that all intellectual property in all course content is owned by the Commonwealth of Australia with the ABS administering the intellectual property.
You must not not alter the content contained in the LMS or use it in any other form.
