Criminal offence information and other data necessary to process and manage restraining order applications is recorded. Description Information is recorded in Children’s Court and Petty Sessions system (CHIPS) and stored in the data Warehouse, called ‘Courts Data Mart’ in summarised form. Definition of Family and Domestic Violence Family and domestic violence is defined by the Magistrate’s court for policy purposes as:
The Acts Amendment (Family and Domestic Violence) Act 2004 defines Family and Domestic Violence for the purpose of restraining orders as: one of the following acts that a person commits against another person with whom he or she is in a family and domestic relationship —
(c) damaging the person’s property, including the injury or death of an animal that is the person’s property; (d) behaving in an ongoing manner that is intimidating, offensive or emotionally abusive towards the person; (e) pursuing the person or a third person, or causing the person or a third person to be pursued- (i) with intent to intimidate the person; or (ii) in a manner that could reasonably be expected to intimidate, and that does in fact intimidate, the person; (f ) threatening to commit any act described in paragraphs (a) to (c) against the person. A family or domestic relationship is defined to include current or former intimate partners, persons who are related and children who ordinarily reside with a person. Collection methodology Most charge data is transferred electronically from the Western Australia Police. This data transfer includes a domestic violence and child abuse flag, indicating that the charges arose from circumstances of domestic violence and/or there was an element of child abuse. For restraining orders, FDV related applications are identified using the relationship between parties information. Applicants identify the relationship between parties at the time they lodge the application. This is done on the application form. Scope / target population All persons against whom charges have been laid and applications have been made in respect of. Coverage Information about all proceedings within the Children’s Court of WA and the Magistrates Court of WA are included in this database. Geographic coverage and disaggregation Western Australia. Full address of offender recorded. Data available for: Western Australia Other - Court location Other - for restraining orders, address of applicant and respondent can be extracted for further disaggregation, subject to quality and confidentiality constraints Frequency / Timing Updated continually Ad hoc - FDV statistics produced on request only. Access to this data may be available upon request. Requests for data from agencies or researchers will be assessed on their merits and availability of court resources to extract the data. Data are only released with approval from the head of jurisdiction.
