SUBDIVISION 104 POSSESS AND/OR USE ILLICIT DRUGS
The possession of a non-commercial quantity and/or use of an illicit drug or other controlled substance.
This subdivision is disaggregated on the basis of possession and use of non-commercial quantities of illicit drugs or other controlled substances.
Offences in this subdivision are classified into the following groups:
1041 Possess illicit drugs
1042 Use illicit drugs
Exclusions:
Possess commercial/trafficable quantity of illicit drug. These are coded to Subdivision 102, Deal or traffic in illicit drugs.
1041 Possess illicit drugs
The possession of a non-commercial quantity of an illicit drug or controlled substance for which possession or use is prohibited under legislation.
Exclusions:
Use or self-administration of an illicit drug or controlled substance. These are coded to Group 1042, Use illicit drugs.
1042 Use illicit drugs
The use of an illicit drug or controlled substance, the possession or self-administration of which is prohibited under legislation.
Inclusions:
Self-administer an illicit drug or controlled substance
Exclusions:
Possess an illicit drug or controlled substance. These are coded to Group 1041, Possess illicit drugs.
Administer an illicit drug or controlled substance to another person where further intent is unknown. These are coded to Group 0299, Other acts intended to cause injury, nec.
