SUBDIVISION 062 BLACKMAIL AND EXTORTION

The unlawful demanding with intent to gain money, property, or any other benefit from, or with intent to cause detriment to, another person, accompanied by the use of coercive measures, to be carried out at some point in the future if the demand is not met. This may also include the use and/or threatened use of face-to-face force or violence, provided there is a threat of continued violence if the demand is not met.

This subdivision is not further disaggregated.

Offences in this subdivision are classified into the following group:

    0621 Blackmail and extortion

    The unlawful demanding with intent to gain money, property, or any other benefit from, or with intent to cause detriment to, another person, accompanied by the use of coercive measures, to be carried out at some point in the future if the demand is not met. This may also include the use and/or threatened use of face-to-face force or violence, provided there is a threat of continued violence if the demand is not met.
    Coercive measures include, but are not limited to, the threat of:

    • force or violence;
    • the misuse of authority;
    • criminal prosecution;
    • the destruction of a person’s reputation or social standing; or
    • the destruction of a person’s property.

    Inclusions:
    Demand money/property with menaces via indirect means e.g. a letter
    Industrial/corporate extortion

    Exclusions:
    Demand/take property via immediate threat only where there are no further, or continued, threats made. These are coded to the relevant groups within Subdivision 061, Robbery.
    Robbery that does not include threats of coercive measures to be carried out in the future. These are coded to Subdivision 061, Robbery.
