SENTENCE OUTCOMES

In the Higher Courts, 90% of defendants proven guilty received a custodial order as their principal sentence, compared with 9% in the Magistrates' Courts and 10% in the Children's Courts. Almost one-third (32%) of all custodial orders were for defendants finalised for Fraud and deception.

Across all court levels, custodial orders were most common for defendants with a principal federal offence, at the ANZSOC division level, of Sexual assault (79%) and Illicit drug offences (79%).

Defendants sentenced to non-custodial orders (community supervision or work orders, monetary orders and other non-custodial orders) accounted for 83% (6,275) of defendants proven guilty in all court levels.

For All Courts, defendants proven guilty with a principal federal offence of Fraud and deception had the highest proportion of community supervision or work orders (17%). The majority of defendants with a principal federal offence of Traffic (98%) and Offences against justice (77%) were sentenced to monetary orders.
